DMCA Policy

DMCA Policy

MDS Site and Power (referred to as “MDS Site and Power,” “we,” “us,” or “our”) respects the intellectual property rights of others. We are committed to maintaining a platform where original white papers and research are shared responsibly. Our policy is to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”).

Filing a DMCA Takedown Notice

If you believe content on mds-siteandpower.com infringes your copyright, you may send us a written DMCA takedown notice. Your notice must include all of the following information. Failure to provide complete information may delay or prevent the removal of the material.

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  • Identification of the copyrighted work you claim has been infringed. Include details such as the title of the work and any applicable registration numbers.
  • Identification of the material you claim is infringing and where it is located on our site (e.g., URL link).
  • Your name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Counter-Notification Process

If your content was removed following a DMCA notice, and you believe the removal was a mistake, you may submit a counter-notification. We will forward your counter-notification to the party who filed the original infringement claim. To be effective, a counter-notification must be in writing and contain the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or if outside the U.S., any judicial district where MDS Site and Power may be found). You must also agree to accept service of process from the person who provided the original DMCA notification.

We typically restore the removed material within 10 to 14 business days after receiving a valid counter-notification. This occurs unless the copyright owner files a court action seeking a court order to restrain the content provider from engaging in infringing activity.
